Terms & Conditions

Last updated: 1 October 2026
Welcome to MyDomestic.
These Terms and Conditions ("Terms") explain the rules for using our website at www.my-domestic.co.za and our web app at app.my-domestic.co.za (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
We have tried to write these Terms in plain language. Clauses that limit our liability, place risk or responsibility on you, or ask you to indemnify us are shown in bold, as required by the Consumer Protection Act, 2008 ("CPA"). Please pay special attention to them.

In these Terms, "we", "us" and "our" mean MyDomestic, and "you" and "your" mean the person who registers for and uses the Service.
1.2 What MyDomestic does
MyDomestic is an online tool that helps South African household employers manage the employment of their domestic workers.
The free plan (free forever) includes:
-
adding your workers and keeping their employee records;
-
tracking leave;
-
recording loans and loan repayments;
-
recording ad hoc expenses;
-
recording benefits in kind;
-
working out pay;
-
listing and recording payments made, and the payment method used; and
-
our guides, including general guidance on the Unemployment Insurance Fund ("UIF") and the Compensation Fund ("COIDA").
The Premium plan (R240 per year) adds:
-
employment contracts;
-
payslips;
-
UIF summaries;
-
automatic generation of the six annual Compensation Fund (COIDA) documents (our ROE Document Kit), to make your Return of Earnings ("ROE") submission easier; and
-
warnings and dismissals.
You can also invite a second user (for example a spouse or partner) to your account.
The Service is designed for employers. Your domestic workers do not log in or have accounts. You may share documents (like payslips or contracts) with them yourself.
We may add, change or remove features from time to time to improve the Service. If we remove a major Premium feature during a paid year, clause 1.8.7 applies.
1.3 Important: we are not your lawyer, accountant or labour consultant
Please read this clause carefully.
MyDomestic provides software tools, templates, calculators and general information only. Nothing in the Service is legal, labour, tax or financial advice, and using the Service does not create an attorney–client or adviser–client relationship.
As the employer, you remain fully responsible for complying with all laws that apply to you and your employees, including (without limitation):
-
the Basic Conditions of Employment Act, 1997 (BCEA) and Sectoral Determination 7 (Domestic Worker Sector);
-
the National Minimum Wage Act, 2018;
-
the Unemployment Insurance Act, 2001 and the Unemployment Insurance Contributions Act, 2002 (UIF registration, declarations and contributions);
-
the Compensation for Occupational Injuries and Diseases Act, 1993 (COIDA registration, returns and assessments);
-
the Labour Relations Act, 1995;
-
tax laws, where applicable; and
-
the Protection of Personal Information Act, 2013 (POPIA), in respect of your employees' personal information.
In particular:
-
Contract templates are general starting points. You must check that each contract reflects your actual arrangement and your worker's circumstances. Consider getting professional advice for anything unusual (for example disputes, or foreign nationals' work permits).
-
Warnings and dismissal documents help you record and follow a process, but they do not guarantee that a warning or dismissal is fair or lawful. A dismissal must have a fair reason and follow a fair procedure under the Labour Relations Act. Please get professional advice before dismissing a worker if you are unsure.
-
Calculations (pay, deductions, leave, UIF contributions and similar) depend on the information you enter. Please check them before relying on them.
-
Minimum wage information and guidance are based on the rates and rules we are aware of at the time. Laws and rates change (often annually), and there may be a delay before we update the Service. Always confirm current rates with the Department of Employment and Labour.
-
UIF summaries, Compensation Fund (COIDA) documents and guidance are prepared from the information you enter and explain the general process. You must check them before you use them. We do not register you, submit declarations or Returns of Earnings, or make payments to the UIF or the Compensation Fund on your behalf.
If you are unsure about your obligations, please speak to a qualified labour law practitioner, accountant or the Department of Employment and Labour.
1.4 Who may use the Service
The Service is offered in South Africa only. To use the Service you must:
-
be at least 18 years old and able to enter into a binding agreement;
-
be an employer (or prospective employer) of a domestic worker in South Africa, or someone helping such an employer with their permission; and
-
give us true, accurate and complete registration information, and keep it up to date.
1.5 Your account
-
Keep your login details safe. You are responsible for everything done through your account, unless it happens because of our fault. Tell us immediately at support@my-domestic.co.za if you think someone has accessed your account without permission.
-
Second user. You may invite one additional person to access your account. You are responsible for choosing who you invite, for what they do in your account, and for making sure they also follow these Terms. You can remove their access at any time.
-
One household. An account is intended for use by a single household (one employer, who may employ more than one domestic worker). If you manage domestic workers for more than one household, please open a separate account for each household.
-
We may suspend or close your account if you seriously or repeatedly breach these Terms, use the Service unlawfully, or if we are required to do so by law. Where reasonable, we will warn you first and give you a chance to fix the problem and export your data.
1.6 Your employees' information
When you add information about your domestic workers (such as names, ID or passport numbers, contact details, bank details, pay, leave and loan records), you are the "responsible party" for that information under POPIA, and we process it on your behalf as your "operator". Our Privacy Policy explains this in more detail.
You confirm that:
-
you have a lawful reason to collect and store your employees' information (for example, to meet your employment and legal obligations);
-
you have told your employees that you use MyDomestic to keep their employment records, and what information you store; and
-
the information you enter is accurate and you will keep it up to date.
We will only use your employees' information to provide the Service to you, as described in our Privacy Policy, and will keep it secure as required by POPIA.
1.7 Acceptable use
You agree not to:
-
use the Service for any unlawful purpose, or to exploit or treat any worker unfairly or unlawfully;
-
enter information about people you have no lawful reason to process;
-
try to gain unauthorised access to the Service, other users' accounts or our systems;
-
upload viruses or harmful code, or interfere with the proper working of the Service;
-
copy, resell, reverse engineer or commercially exploit the Service (except for your own household use) without our written permission; or
-
use automated tools to scrape or extract data from the Service.
Fair use of Premium. We may suspend or restrict your access to Premium features (for example, document generation) if we reasonably believe your account is being used abusively or fraudulently. This includes, for example, where a refund or chargeback has been obtained after Premium documents were generated, or where repeated trials or accounts are used to avoid paying. Where reasonable, we will tell you why and give you a chance to respond. Your free plan features and your data are not affected.
1.8 Pricing, Premium subscription and auto-renewal
1.8.1 Free plan
Basic use of MyDomestic is free forever. The free plan includes the features listed in clause 1.2. We may change which features are included in the free plan, but we will not start charging you for the free plan without your agreement.
1.8.2 Premium plan
Premium gives you access to the additional features listed in clause 1.2 and described on our website at the time you subscribe. Premium costs R240 per year. MyDomestic is not registered for VAT, so no VAT is charged. There are no delivery or other hidden charges.
1.8.3 Free Premium trial
New users may try Premium free for 30 days. No card or payment details are needed for the trial.
The following are not included in the free trial:
-
generating employment contracts;
-
inviting another household member as a second user; and
-
generating the ROE Document Kit (the six annual Compensation Fund documents).
During the trial you can see a preview of these features, but you can only use them once you subscribe to Premium. All other Premium features are available during the trial.
When the trial ends, your account simply returns to the free plan unless you choose to subscribe to Premium. Premium features will then show a blurred preview until you subscribe. You will not be charged anything unless you subscribe.
We may limit trials to one per person or household.
1.8.4 How payment works
Payments are processed securely by our third-party payment provider, PayFast. Premium is a recurring annual subscription processed by PayFast. We do not see or store your card details. You can pay using the recurring payment methods PayFast makes available at checkout (for example credit or debit card). By subscribing, you authorise PayFast to charge your chosen payment method R240 (or the then-current price notified to you under clause 1.8.6) at the start of each subscription year.
1.8.5 Auto-renewal
Premium is an annual subscription that renews automatically. Unless you cancel, your subscription will renew for a further 12 months at the end of each subscription year, and PayFast will charge the annual fee on the renewal date.
We will email you reminders before each renewal (about 70 days and again 7 days before the renewal date), telling you the renewal date, the amount, and how to cancel.
1.8.6 Price changes
We may change the Premium price from time to time. Any price change will only apply from your next renewal, and we will tell you by email at least 60 days before it takes effect. If you don't want to continue at the new price, you can cancel before the renewal date.
1.8.7 Changes to Premium features
If we remove a major Premium feature during a paid subscription year, we will tell you by email or in the app, in advance where we reasonably can. You may cancel so that your subscription does not renew. Refunds are dealt with under our Refund and Cancellation Policy, including where the law requires a refund.
1.8.8 Failed payments
If a renewal payment fails, we will let you know and PayFast may try again. If we can't collect payment within 14 days, your account will move to the free plan. Your data will not be deleted because of a failed payment.
1.8.9 Invoices and records
We (or PayFast on our behalf) will send you a payment confirmation or receipt by email after each payment. You can keep, print or save these for your records. If you need a copy, email support@my-domestic.co.za.
1.9 Cancellation and refunds
You can cancel your Premium subscription at any time inside the app, on the Subscribe page, by tapping "Cancel subscription", or by emailing support@my-domestic.co.za. Cancelling stops your next renewal. Your Premium access continues until the end of the year you have already paid for. Premium then locks automatically and your account moves to the free plan.
Once an annual subscription has been paid and the subscription year has started, we do not give refunds, except where the law requires a refund. Our Refund and Cancellation Policy (below, and on our website) forms part of these Terms and explains how this works. Nothing in these Terms limits rights you have under the CPA or the Electronic Communications and Transactions Act, 2002 ("ECTA") that cannot lawfully be excluded.
You may also close your free account at any time. See clause 1.12 about your data.
1.10 Our intellectual property
The Service, including its software, design, text, templates, logos and the name "MyDomestic", belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service for managing your own household's domestic employment while your account is active. You may use, print and share contracts, payslips and other documents generated for your own household. You may not otherwise copy, sell or distribute our content or templates.
Your data belongs to you. You give us permission to store and process it only so we can provide the Service to you.
1.11 Availability and support
We work hard to keep the Service running smoothly, but we cannot promise that it will always be available, uninterrupted or error-free. The Service runs on third-party infrastructure (including our platform provider, Base44) and may be unavailable for maintenance, updates, or reasons outside our control, such as internet or power outages (including load-shedding).
Support is provided by email only, at support@my-domestic.co.za. We aim to respond within 5 business days.
1.12 Your data when you cancel or close your account
-
If you cancel Premium, your account moves to the free plan at the end of your paid period and your data stays in your account. Records you created with Premium features are not deleted, but you will not be able to use Premium features (such as creating new contracts or payslips) until you subscribe again.
-
Please export or download any records you need before closing your account. Employers must keep certain employment records for a minimum period (for example, the BCEA requires certain records to be kept for at least three years).
-
If you close your account, we will delete or de-identify your account data and your employees' data within 30 days, except where we must keep certain information by law (for example, payment and tax records), as explained in our Privacy Policy.
1.13 Limitation of liability
Please read this clause carefully. It limits our responsibility to you.
To the extent allowed by law (including the CPA):
-
The Service is provided "as is" and "as available". We do not guarantee that the Service, its templates, calculations, documents or guidance will be complete, error-free, up to date or suitable for your particular circumstances.
-
We are not liable for any loss or damage arising from: your reliance on the Service instead of professional advice; incorrect or incomplete information you enter; your failure to comply with any employment, UIF, COIDA, tax, minimum wage or privacy law; penalties, interest, awards, back-pay or claims made against you by employees, the CCMA, the Department of Employment and Labour, the UIF, the Compensation Fund, SARS or any other authority; or events outside our reasonable control.
-
We are not liable for any indirect or consequential loss, loss of profit or loss of data (other than our obligation to take reasonable security measures under POPIA).
-
Our total liability to you for any claim relating to the Service is limited to the total amount you paid us in the 12 months before the event giving rise to the claim (and, if you use only the free plan, R240).
Nothing in these Terms limits or excludes our liability for gross negligence, fraud or wilful misconduct, or any liability or right that cannot be limited or excluded under the CPA or other law.
1.14 Indemnity
You agree to indemnify us (hold us harmless) against any claims, losses, penalties or legal costs brought against us by a third party (including your employees or any authority) that arise from your breach of these Terms, your unlawful use of the Service, or your failure to comply with employment, privacy or other laws in relation to your employees — except to the extent that the claim is caused by our own breach, negligence or misconduct.
1.15 Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the law or in the Service. We will post the updated Terms on our website with a new "last updated" date. If a change is significant, we will notify you by email or in the app at least 30 days before it takes effect. If you don't agree with the changes, you may cancel your account or your Premium subscription before they take effect, and your subscription will not renew. Continuing to use the Service after the changes take effect means you accept them.
1.16 Complaints and disputes
If you have a complaint, please email support@my-domestic.co.za first. We will acknowledge it within 5 business days and try to resolve it fairly and quickly.
If we can't resolve it, you may refer the matter to the National Consumer Commission, the Consumer Goods and Services Ombud (where applicable), a consumer court or tribunal, or any other forum available to you under the CPA or other law. Privacy complaints may also be sent to the Information Regulator (see our Privacy Policy).
1.17 Governing law
These Terms are governed by the laws of the Republic of South Africa. Subject to your rights under the CPA to approach other forums, you agree that the South African courts have jurisdiction, and that we may be sued in the Magistrate's Court having jurisdiction, even if the amount claimed exceeds that court's normal limit.
1.18 General
-
Electronic communications. You agree that we may communicate with you electronically (by email or in the app), and that these communications meet any legal requirement for writing, as provided in ECTA.
-
Entire agreement. These Terms, our Privacy Policy and our Refund and Cancellation Policy are the whole agreement between you and us about the Service.
-
Severability. If any part of these Terms is found to be invalid or unenforceable, the rest remains in force.
-
No waiver. If we don't enforce a right immediately, we haven't given it up.
-
Transfer. We may transfer our rights and obligations under these Terms to another person or business that takes over MyDomestic, provided your rights are not reduced. We will tell you if this happens.
-
Your statutory rights. Nothing in these Terms limits rights you have under the CPA or ECTA that cannot lawfully be excluded.
